I can't imagine the losses are too great. If anything, spreading word about this technology might actually be improving revenue for Tomita. I'm sure this is just Tomita trying to make a quick dollar without having to put effort into it.

As for the 3DS, I'm not worried about it being discontinued. Even if Tomita would win, Nintendo would probably opt to settle this out of court by pulling out their checkbook.

Oh yeah, I didn't know you can patent technology. That's kind of strange.

you can patent anything so long as you have a working prototype i think. But the technology has to be the same as defined in the patent.

If I remember, Tesla had patents on a whole load of stuff that he couldn't have possibly made back in his day. He knew the theoretics and science behind it. (I daresay a hop skip over to wiki or some such would tell you more than I could). XD

Why is it everyone tries to tango with Nintendo on a legal standpoint? I remember a couple years back someone sued them over the technology in the Wii remotes.

Tech companies are almost always suing one another over something. There's that infographic of all the phone companies which just goes to show how widespread it all is. If it goes in Tomita's favour, they'll just end up receiving royalties from Nintendo, giving them a nice little revenue stream.
